indifeed Terms of Service
Effective date: 4 September 2026
These Terms of Service ("Terms") govern your use of indifeed, a service operated by Bit Monkey Ltd, company number 17306463, registered in England and Wales ("Bit Monkey", "we", "us" or "our").
By creating an account, purchasing a subscription or using the service, you agree to these Terms.
1. Business use
indifeed is provided as a business service.
If you create an account on behalf of an organisation, you confirm that you have authority to accept these Terms on its behalf.
References to "Customer" mean the person or organisation that has entered into these Terms with us.
2. The service
indifeed provides tools for collecting, organising, managing and acting upon feedback and related information.
We may improve, modify or replace features over time.
We will not materially reduce the overall functionality of a paid service during a subscription period without reasonable justification.
We may provide beta, experimental or preview features. Such features may change or be withdrawn and may be subject to additional limitations.
3. Accounts
You are responsible for:
- providing accurate account information;
- maintaining appropriate control of your account;
- ensuring that authorised users comply with these Terms; and
- notifying us promptly if you believe an account has been compromised.
You must not share authentication credentials in a way that enables unauthorised access.
4. Customer content
"Customer Content" means information submitted, stored or transmitted through the service by or on behalf of a Customer, including feedback submitted by the Customer's users.
The Customer retains ownership of its Customer Content.
The Customer grants Bit Monkey the limited rights necessary to host, process, copy, transmit and otherwise handle Customer Content for the purpose of:
- providing the service;
- maintaining its security and reliability;
- providing support;
- complying with the Customer's instructions; and
- complying with applicable law.
We obtain no broader ownership rights in Customer Content.
Where indifeed uses AI functionality, Customer Content may be submitted to Cloudflare Workers AI for inference. Bit Monkey does not use Customer Content to train general-purpose AI models.
5. Responsibility for Customer Content
The Customer is responsible for:
- deciding what information it collects through indifeed;
- ensuring that it has an appropriate legal basis for collecting and processing personal information;
- providing any privacy information required to its users;
- responding to data protection requests where it is the controller;
- ensuring that its use of indifeed complies with applicable law; and
- ensuring that Customer Content does not infringe another person's rights.
Bit Monkey does not determine the purposes for which a Customer collects feedback or other Customer Content.
6. Acceptable use
You must not use indifeed:
- unlawfully or fraudulently;
- to infringe another person's intellectual property, privacy or other rights;
- to distribute malware or malicious code;
- to attempt unauthorised access to systems or data;
- to interfere with the operation or security of the service;
- to conduct vulnerability testing without our permission, except as permitted by our published vulnerability disclosure policy;
- to send unlawful spam or abusive communications;
- to impersonate another person or organisation; or
- in a way that could reasonably cause material harm to the service or other customers.
Automated access is permitted where provided through our documented APIs, integrations, command-line tools or agent interfaces and used within reasonable technical limits.
7. Fees and subscriptions
Where the service is provided on a paid basis, the Customer agrees to pay the prices shown when subscribing or otherwise agreed with us.
Unless stated otherwise:
- subscription fees are charged in advance;
- applicable taxes may be added;
- subscriptions renew automatically for the relevant subscription period until cancelled; and
- cancellation prevents future renewal but does not normally result in a refund for a subscription period that has already started.
We may change prices for future subscription periods by giving reasonable notice.
Any different pricing or payment terms agreed in writing with a Customer will take precedence over this section.
Payments are processed using Stripe and may also be subject to Stripe's applicable terms and privacy information.
8. Third-party services
indifeed may integrate with or depend upon third-party services.
We are not responsible for third-party products or services that are outside our control.
Your use of a third-party service may also be subject to that provider's own terms.
9. Availability and maintenance
We aim to operate indifeed as a reliable production service.
However, we do not guarantee uninterrupted or error-free availability.
The service may occasionally be unavailable because of:
- planned maintenance;
- emergency maintenance;
- infrastructure or network failures;
- security incidents;
- failures of third-party providers; or
- circumstances beyond our reasonable control.
Where reasonably practicable, we will seek to minimise disruption.
Any specific service-level commitment must be agreed separately in writing.
10. Security
We maintain technical and organisational measures designed to protect the confidentiality, integrity and availability of Customer Content.
Customers remain responsible for configuring and using their accounts securely, managing authorised users and protecting credentials under their control.
Further information is provided in our Security Policy at https://indifeed.dev/legal/security.
11. Data protection
Each party must comply with applicable data protection law.
For personal information that Bit Monkey processes for its own purposes, Bit Monkey acts as controller as described in our Privacy Policy.
Where Bit Monkey processes personal information contained in Customer Content solely on behalf of the Customer, Bit Monkey acts as processor and the Customer acts as controller or processor, as applicable.
Where Bit Monkey processes Customer Personal Data on behalf of the Customer, the Data Processing Agreement at https://indifeed.dev/legal/dpa forms part of these Terms.
12. Intellectual property
Bit Monkey and its licensors retain all intellectual property rights in:
- indifeed;
- its software;
- APIs;
- documentation;
- website;
- branding; and
- other materials supplied as part of the service.
Except for the rights expressly granted under these Terms, no intellectual property rights are transferred to the Customer.
Nothing in these Terms prevents Bit Monkey from independently developing products, features or ideas similar to suggestions or feedback provided about indifeed, provided that we do not improperly use confidential Customer Content in doing so.
13. Confidentiality
Each party may receive confidential information belonging to the other.
A receiving party must:
- use confidential information only for purposes connected with the service;
- take reasonable steps to protect it; and
- disclose it only where necessary to people who are subject to appropriate confidentiality obligations.
These obligations do not apply to information that is publicly available through no breach of these Terms, was already lawfully known, was independently developed, or must legally be disclosed.
14. Suspension
We may suspend access to some or all of the service where reasonably necessary to:
- prevent or respond to a security threat;
- prevent unlawful activity;
- protect other customers or the service;
- address a material breach of these Terms; or
- deal with overdue payment.
Where reasonably practicable, we will notify the Customer and provide an opportunity to remedy the issue.
15. Termination
Either party may terminate an ongoing subscription in accordance with the cancellation arrangements applicable to that subscription.
Either party may terminate these Terms if the other party commits a material breach and, where the breach can be remedied, fails to remedy it within a reasonable period after receiving notice.
We may terminate immediately where continued provision of the service would be unlawful or would create a material security risk.
Following termination, the Customer's right to use the service ends.
We will provide reasonable arrangements for deletion or export of Customer Content as described in our documentation or applicable Data Processing Agreement.
16. Warranties
We will provide the service with reasonable care and skill.
Except as expressly stated in these Terms, and to the extent permitted by law, the service is provided without other warranties, conditions or representations, whether express or implied.
We do not warrant that:
- the service will always be available;
- it will be entirely free from defects;
- every feature will remain unchanged; or
- the service will be suitable for every particular business purpose.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot legally be excluded.
Subject to that:
Neither party will be liable for indirect or consequential loss, or for loss of profit, revenue, anticipated savings, business opportunity or goodwill, except where such loss forms part of a claim that cannot lawfully be excluded.
Bit Monkey's total aggregate liability arising out of or relating to the service during any twelve-month period will not exceed the total fees paid or payable by the Customer for the service during the twelve months immediately preceding the event giving rise to the claim.
The limitations in this section reflect the nature and pricing of the service.
18. Events outside our control
Neither party will be responsible for failure or delay caused by circumstances outside its reasonable control.
19. Changes to these Terms
We may update these Terms from time to time.
For material changes affecting an existing paid subscription, we will provide reasonable notice.
Changes required for legal, regulatory or security reasons may take effect sooner where necessary.
Continued use of the service after updated Terms become effective constitutes acceptance of those Terms where permitted by law.
20. General
If a provision of these Terms is found to be unenforceable, the remaining provisions continue in effect.
A failure to enforce a provision does not waive the right to enforce it later.
The Customer may not transfer these Terms without our consent, except as part of a genuine sale or reorganisation of its business.
Bit Monkey may transfer these Terms as part of a corporate reorganisation, financing, merger or sale of the relevant business.
These Terms constitute the agreement between the parties concerning the service unless another written agreement expressly replaces or modifies them.
21. Governing law
These Terms and any dispute arising from them are governed by the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction.
